JUSTICE SANJAY PRIYA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioner, the informant and the learned A.P.P. for the State.

The petitioner seeks bail in Madhepura P.S. Case No. 878/2017, instituted for the offences under Sections 341, 323, 324, 307, 379, 427 and 506/34 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that there is land dispute between the parties. Title Suit No. 197/2003 is pending between them.

In the written report, it is alleged against this petitioner that he caused injury to informant by means of arrow on the right side of head.

Injury report along with case diary has been received

Patna High Court Cr.Misc. No.54651 of 2018 (4) dt.04-10-2018 2/2 wherein doctor has found two injuries on the person of informant, i.e. on the right parietal region of size 1" deep and 1" breadth caused by sharp and pointed object and bruise over right hand index finger of size 1"x1" caused by hard and blunt object. Learned counsel for the petitioner has submitted that petitioner was arrested in this case on 15.05.2018 after rejection of anticipatory bail.

Learned counsel for the informant has opposed the prayer for bail of the petitioner.

From the written report, it appears that informant has sustained only one injury.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 878/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
