JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-09-2018 The petitioner seeks regular bail in connection with Phulparas P.S. Case No. 242 of 2017, registered for offences punishable under Sections 448, 147, 148, 149, 302, 307 and 120(B) of Indian Penal Code and Section 27 of the Arms Act. Allegation against one Pramod Yadav is of firing causing death of one Rasindra Mandal and other accused persons also fired on different persons causing injuries to them and in the meantime, some persons assaulted the co-accused Binod Yadav on his head, due to which, he died.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and there is no allegation of assaulting either the deceased Rasindra Mandal or others and though petitioner is an accused in seventeen other cases but in

Patna High Court Cr.Misc. No.45332 of 2018 (3) dt.07-09-2018 2/2 twelve cases, he has been acquitted and in some cases, he is on bail.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and also the criminal antecedent of the petitioner, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
