2. The petitioner has prayed for bail in connection with Jogbani P.S. Case No. 112 of 2025 registered for the offence punishable under Sections 8(c) and 21(b) of N.D.P.S. Act.
3. The case of the prosecution, in short, is that from the possession of this petitioner 6.5 grams of smack and mobile was recovered from his house.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has been submitted that though the contraband which has been recovered from the possession of this petitioner is
Patna High Court CR. MISC. No.76452 of 2025(2) dt.19-11-2025 2/2 more than small quantity but is much less than commercial quantity. Petitioner is having one criminal antecedent which is not of similar nature. He is languishing in judicial custody since 25.09.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Araria in connection with Jogbani P.S. Case No. 112 of 2025. (Ashok Kumar Pandey, J) lata/- U T
