Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 324, 326, 307, 332, 333, 379, 380, 353 of the Indian Penal Code and section 27 of the Arms Act and section 17 of the C.L.A. Act. Later on sections 395, 397 and 121 of the Indian Penal Code were added.
The F.I.R. is against unknown. Petitioner is in custody since 16.01.2014 whereas some other accused have been allowed bail by other Coordinate Benches of this Court as stated in para 8 and 9 of the bail petition.
Considering the aforesaid facts especially the period of custody already undergone by the petitioner, let the petitioner
Patna High Court CR. MISC. No.23971 of 2018(5) dt.09-04-2019 2/2 above-named, be released on bail on furnishing bail bond of Rs. 20,000 (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Akbar Nagar P.S. Case No. 04/2010 corresponding to Sessions Trial No. 1134/2013, subject to the condition that one of the bailors shall be government servant and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
