JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mahanar P.S. Case No. 395 of 2018 registered for the offences punishable under Sections 341, 324, 307, 504, 506/34 of the Indian Penal Code and section 25(1-b) A, 26, 35 and 27 of the Arms Act.

The first information report reflects that there was serious land dispute between the parties and civil suit was going on between the parties at the time of alleged occurrence. No doubt, there is allegation against the petitioner that he opened fire which caused injury on the right foot of informant's son but the injury report goes to show that the injured sustained simple injury.

No.74384 of 2019(4) dt.06-03-2020 2/2 Learned counsel of the informant opposes the prayer for bail on the ground that petitioner does have criminal antecedent and there is specific allegation of firing against him. Learned counsel of the petitioner submits that all the cases were instituted against the petitioner by his enemies on account of land dispute and moreover, the police submitted final form in almost all the cases.

Considering the aforesaid facts of the present case as well as submissions of the parties, let above named, petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, -VI, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 395 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
