JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajoun P.S. Case No. 489 of 2017 instituted for the offence under Sections 302, 201 and 120(B)/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is named in the written report merely on suspicion. Counsel for the petitioner further submits that in the Fard-e-beyan it is alleged that two persons namely, Bansidhar Rai and Bouni Thakur came and reserved the Tempo to go to Jagdishpur. The son of informant was driving the tempo. Later on, the dead body of son of the informant was recovered. Counsel for the petitioner further submits that name of petitioner has come during investigation on the basis of confessional statement of Panna Lal Mahto @ Panna

Patna High Court Cr.Misc. No.48537 of 2018 (3) dt.27-09-2018 2/2 Lal, who has already been granted bail by a coordinate Bench of this Court vide order dated 03.05.2018 passed in Cr. Misc. 25143 of 2018.

Petitioner is said to be in custody since 28.9.2017. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajoun P.S. Case No. 489 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
