2. The petitioner seeks bail in connection with Rosera P.S. Case No. 323 of 2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 354, 379, 120B of the Indian Penal Code.

3. The petitioner is the assailant of the deceased and he is in jail since 19.05.2023. It has been submitted by learned counsel for the petitioner that the petitioner and the deceased are full brother and the occurrence has taken place due to land dispute. The petitioner has also been sustained injury in this case.

4. Learned APP appearing for the State and learned counsel for the informant oppose the prayer for regular bail of

Patna High Court CR. MISC. No.80485 of 2023(3) dt.05-03-2024 2/2 the petitioner.

5. Be that as it may, since the petitioner is the assailant of the deceased, I am not inclined to grant bail to the petitioner.

6. Accordingly, this application stands dismissed.
