Petitioner seeks bail in Brahmpur P.S. Case No.545 of 2018 registered under Sections 406 and 409 of the IPC. The petitioner being the Secretary of Ward Implementation and Management Committee was entrusted to lay the pipes in each and every house of Ward No.2 of Kant Panchayat. The petitioner along with President, namely, Gita Devi withdrew Rs.8 lacs for execution of the scheme for laying pipes to provide water to each and every family of the Ward but till institution of the present case, the petitioner has not completed the work under the Scheme.
Learned counsel for the petitioner submits that it is admitted that the petitioner withdrew Rs.8 lacs from the total sanctioned cost of the scheme Rs.14,40,792/-. It is further

No.69922 of 2019(4) dt.11-12-2019 2/2 submitted that the Block Development Officer, Brahmpur submitted report on 07.12.2019 that the petitioner has completed the works of laying pipes in Ward No.2 of Kant Panchayat. The report is Annexure 8. The petitioner is in jail since 20.09.2019. Having considered the facts that the petitioner has already completed the entire works of laying pipes to each and every house in Ward No.2 of Kant Panchayat, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Buxar in connection with Brahmpur P.S.
