06-10-2018 Heard Sri Dewendra Narayan Singh, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, apprehending his arrest in Chapra Town P.S. Case No. 39 of 2017 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph-3 of the petition to show that petitioner is having clean antecedent. It has been argued that though, a tractor, having registration number of tractor of the petitioner, was intercepted by the police carrying huge quantity of Indian make foreign liquor, the tractor of the petitioner was already standing near the house of the petitioner

Patna High Court Cr.Misc. No.55363 of 2018(3) dt.06-10-2018 2/2 and it was not subject matter of the seizure. He submits that during investigation, the engine number was verified, which has not been tallied with the engine number of the vehicle of the petitioner.

In view of the facts and circumstances as well as clean antecedent of the petitioner, which fact has been stated in paragraph - 3 of the petition, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Lalan Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Saran at Chapra in connection with Chapra Town P.S. Case No. 39 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
