1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 45 of 2016 dated 16.02.2016 registered for the offence(s) punishable under Section(s) 302 and 120B read with Section 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(2)(v) of the SC/ST Act.

3. The main submissions advanced by learned counsel for the petitioner are that this is second attempt of the petitioner to get the relief of regular bail and his earlier bail prayer was rejected by this Bench vide order dated 14.09.2022 passed in Cr. Misc. No. 22050/2022 and petitioner

Patna High Court CR. MISC. No.81581 of 2023(3) dt.19-01-2024 2/2 has again come before this Court mainly on the ground of his long incarceration period as he has completed more than seven years in jail.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Heard both the sides. Though the petitioner has been languishing in jail in the present matter for a long period but as per the status of the petitioner's trial sent by the trial court, his case is running for recording his statement, hence in view of this fact it will not be proper to enlarge the petitioner on bail at this stage. Accordingly, petitioner's bail prayer stands rejected.

6. The trial Court is directed to conclude the petitioner's trial within one month from the date of receipt of this order's copy.
