The present writ petition has been filed for the following reliefs:-

1. for issuance of an appropriate writ, order direction to respondents restraining them from taking any further action in pursuance of letter no. 1958 dated 31.12.18 send by Respondent no. 6 to Respondent no.5 in reference of letter no. 1036 dated 04.08.16 issued by D.M. Nawada for the creation of Nagar Panchayat after carving out part area of Gram Panchayat Raj Rajauli (west), part area of Gram Panchayat Rajauli (East)

Patna High Court CWJC No.25346 of 2019(3) dt.23-06-2023 2/2 and part area of Gram Panchayat Raj Takuatanrh of DistrictNawada;

2. for issuance of an appropriate writ order direction declaring that without fulfilling the required ratio of agriculturist and non agriculturist in a locality, the action for creation of Nagar Panchayat in the area is in violation of requirement provided under law;

3. for issuance of an appropriate writ, order direction that the action of the respondents to create Nagar Panchayat after carving out of part area of three Gram Panchayat and Total area of a Gram Panchayat at Rajauli is nothing but an action to over- reach the order dated 30.04.2010 passed in C.W.J.C. No. 125/2010.

Learned Counsel for the State submits that with the passage of time, the matter has become infructuous. Be that as it may, since there is no representation on behalf of the petitioner, the petition stands dismissed for nonprosecution. (Rajiv Roy, J) Neha/- U
