2. The petitioner has prayed for bail in connection with Nokha P.S. Case No.374 of 2024 registered for the offence punishable under Sections 70(1) and 3(5) of B.N.S.

3. The case of the prosecution, in short, is that the informant is aged about 35 years. The petitioner took her to his home, kept her for two days and performed 'galat kam' with her. He also brought three persons. They also performed 'galat kam' with her and on 05.10.2024 ousted the informant from his house but the informant was not ready to go her house.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

From perusal of the F.I.R. itself it is clear that the informant has named only the petitioner and the name of those three persons who are alleged to have committed 'galat kam' with her is not disclosed by the informant in the F.I.R. It has further been submitted that from perusal of the medical examination report it will transpire that the doctor conducting medical examination has opined that it is very difficult to say that recent sexual intercourse has to be done or not. It has also been submitted that the allegations are false and without any basis. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 17.07.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sasaram in connection with Nokha P.S.
