The petitioners seek bail in Bagaha (Pathkhauli ) P. S. Case No. 342 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code.

Learned counsel for the petitioners has submitted that both these petitioners have been made accused in this case merely on suspicion because they are having Service Station and they have taken the son of the informant with them Case diary has been received wherein the postmortem report is available which shows that injuries were found on the person of the deceased.

Learned APP after looking into the case diary has

Patna High Court Cr.Misc. No.53544 of 2018(3) dt.08-10-2018 2/2 submitted that none of the witnesses has levelled any specific allegation of assault against this petitioner. Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM 1st Bagaha, in connection with Bagaha (Pathkhauli ) P. S. Case No. 342 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioners.
