JUSTICE ARUN KUMAR JHA ORAL ORDER 28-01-2026 The petitioner has approached this Court for quashing the order dated 05.08.2025 passed by the learned Chief Judicial Magistrate, Saharsa in Saharsa P.S. Case No. 182/2024 whereby and whereunder the learned trial court refused to release the petitioner on compulsive bail under Section 167(2) of Cr.P.C., apart from other reliefs.

02. Apparently, the petitioner has approached this Court against a judicial order passed by the learned Chief Judicial Magistrate, Saharsa.

03. The Hon'ble Supreme Court in the case of Neeta Singh & Ors. Vs. The State Of Uttar Pradesh & Ors. in

Patna High Court CR. WJC No.3083 of 2025(2) dt.28-01-2026 2/2 Special Leave to Appeal (Crl.) No(s). 13578/2024 has held that the judicial orders of the civil court are not amenable to writ jurisdiction under Article 226 of the Constitution. Though the present petition has been filed under Article 226 and 227 of the Constitution of India, but this Court has got no roster of criminal miscellaneous petition under Article 227 of the Constitution of India.

4. Accordingly, the present petition is disposed of as not entertainable.
