2. The present writ application has been filed for the following reliefs:- (i) For issuance of an appropriate writ, order or direction for quashing of the order contained in letter no. ZOPAT: HRM: 29: A-22: 544 dated 14-8-2020 (Anx.-5) passed by the General Manager (ZH), the respondent no. 1 by which the claim of the petitioner for payment of his arrear due salary has been rejected.

(ii) For issuance of an appropriate writ, order or direction directing and commanding the respondents to pay the petitioner his arrear due

Patna High Court CWJC No.17198 of 2023(2) dt.11-09-2025 2/2 salary with all consequential benefits after quashing of the order dated 14-8-2020 (Anx.-5). (iii) For issuance of an appropriate writ directing and commanding the respondents to pay the petitioner interest at market rate for his arrear due salary for the period the same has either not been paid or is not paid.

3. From the impugned order, it appears that the same has been passed without initiating any proceeding which is mandatory under Regulation 47 of BOBOSR, 1979. No order of punishment could have been inflicted upon the petitioner without following Regulation 47 of BOBOSR, 1979.

4. In these circumstances, this writ application is allowed. The order dated 14.08.2020 (Annexure-5) is quashed with liberty to the Bank that it may initiate a proceeding under Regulation 47 of BOBOSR, 1979 and relevant rules and regulations and thereafter pass an order in accordance with law.

5. With the aforesaid liberty to the Bank, this application stands allowed.
