2. The petitioner has prayed for bail in connection with Ahiyapur P.S. Case No. 125 of 2025 registered for the offence punishable under Section 309(6) of the B.N.S. and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that while the informant was returning home on his bike, three miscreants intercepted him and on gun point attempted to snatch the backpack. When the informant objected, they fired at him and took his backpack which has two books, Aadhar card and passbook.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.76457 of 2025(2) dt.19-11-2025 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He has been remanded in this case from Bochahan P.S. Case No. 32 of 2025. Nothing has been recovered from his possession. It has also been submitted that he has been framed in this case due to his criminal antecedent. He is having criminal antecedent of five cases. He is languishing in judicial custody since 11.03.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-11th, Muzaffarpur in connection with Ahiyapur P.S. Case No. 125 of 2025.
