The petitioner seeks regular bail in connection with Special Case No.7086 of 2018 Khajekalan P.R.P.S.Case No.92 of 2018 registered for offences punishable under Sections 30 (A), 32(1) & 38 (1), 37(B) of of Bihar Prohibition and Excise Act, 2016 of the Indian Penal Code.

Allegation against the petitioner is about recovery of 75 ltrs. of mahua liquor from the possession of the petitioner and it appears that he is accused in one more case.. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, though he is accused in one more case but he has been granted bail in that case. Further he is in custody for more than four months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.7086 of 2018, Khajekala P.R.P.S.Case No.92 of 2018..

With the aforesaid observation, this application is allowed.
