1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 342, 323, 324, 307, 427, 354(B), 379 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioner no.1 has antecedent of one case and petitioner no.2 is a person with clean antecedent and on an account of dispute relating to passage, an altercation took place between the side of the petitioners and the informant in which both side assaulted each other. It is further submitted that informant alleges that petitioner no.1 assaulted him by farsha causing injury on head
Patna High Court CR. MISC. No.81854 of 2023(4) dt.25-06-2024 2/2 and petitioner no.2 assaulted his wife on head causing injury. It is next submitted that even the side of the petitioners also suffered injury and F.I.R. has been instituted against the informant and others. It is further submitted that injury suffered by the injured is simple in nature, which amply demonstrates that petitioners never had any intention of committing a serious occurrence.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Pipra P.S. Case No.109/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
