The petitioner seeks pre-arrest bail in connection with Turkauliya (Raghunathpur O.P.) P.S. Case No. 231 of 2019 registered under Sections 304B, 120B, 201 and 34 of the Indian Penal Code.

The accusation is that marriage of Punam Kumari, daughter of the informant, was performed with Amod Giri on 27.06.2018, but, after marriage she was being tortured by her husband and in-laws, due to non-fulfillment of demand of dowry. While the informant went at the sasural of her daughter several occasions and made request, but, there was no change in behaviour of husband and in-laws with her daughter. On arranging the Panchayat the husband and in-laws of her daughter became ready to keep her daughter, who was pregnant, but, later on when she came at her sasural, villagers disclosed that her daughter has been killed by Amod Giri, Krishna Giri,

Patna High Court CR. MISC. No.70470 of 2019(2) dt.18-11-2019 2/2 Bachhi Devi, Subodh Giri and Kiran Devi. She, further, alleged that Amit Giri, Tapesh Gupta and petitioner, Pappu Giri, having hands in the disposal of the dead body.

Submission is that the petitioner is not the in-laws of the daughter of the informant rather the petitioner is a covillager and mere on suspicion of having hand in disposal of the dead body, he has been implicated in this case. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Turkauliya (Raghunathpur O.P.) P.S. Case No. 231 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
