JUSTICE MADHURESH PRASAD ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 395 and 364 of the IPC.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as from perusal of the first information report it would be evident that some miscreants were arrested by the police on the spot and name of the petitioner was disclosed by arrested persons. It has further been alleged that miscreants who were arrested disclosed name of the petitioner as one of the persons who fled away from the place of occurrence. It is further submitted by counsel for the petitioner that co-accused Bhikhari Yadav @ Umesh Kumar Yadav has already been granted privilege of anticipatory bail by a bench of this court vide order dated 30.09.2019 passed in Cr. Misc. no.36424/2019.

Petitioner is in custody since 14.06.2019.

Learned A.P.P. opposes the prayer for bail.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Dhangai P.S. Case no. 34/2016 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his
