Petitioner filed this writ petition for a direction to respondents authorities to consider the representation of the petitioner in terms of Rule 3 read with Rule 5 of the Bihar Nationalized Elementary Teacher Transfer (Disciplinary Action and Promotion) Rules, 2018.

Learned counsel for the petitioner submits that in the case of Lalan Kumar & Ors. (C.W.J.C. No.17306 of 2019), a

Patna High Court CWJC No.21964 of 2019(2) dt.02-12-2019 2/2 bench of this Court disposed of the writ petition with a direction to the District Programme Officer (Establishment), Gaya to consider the case of the petitioner for transfer in view of the decisions of the Education Department.

Having considered the submissions, I dispose of the writ petition with a direction to the District Programme Officer (Establishment), Gaya to consider the case of the petitioner for his transfer in terms of Rule 3 read with Rule 5(kha) of the Bihar Nationalized Elementary Teacher Transfer (Disciplinary Action and Promotion) Rules, 2018 at the earliest preferably within sixty days from the date of receipt/production of a copy of this order.

With the aforesaid direction, this writ petition stands disposed of.
