The petitioner seeks bail in connection with Tajpur (Waini O.P) P.S. Case No. 327 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 9 liters of foreign liquor was recovered from the motorcycle not belonged to the petitioner. Petitioner is in jail custody since 12.09.2019. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent.

In the facts and circumstances of the case, I am

Patna High Court CR. MISC. No.70613 of 2019(2) dt.25-11-2019 2/2 inclined to grant bail to the petitioner, subject to deposit of Rs.5,000/- in the Patna High Court Legal Services Committee, Patna. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additonal Sessions Judge-cum-Special Judge (Excise), Samastipur in connection with Tajpur (Waini O.P) P.S. Case No. 327 of 2019.
