This is an appeal under Section 14(A) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 06.02.2018 passed by the learned Special Judge S.C./S.T., Gaya in Sherghati Police Station Case No.726 of 2017 registered under Sections 452, 376, 511/34 of the Indian Penal Code and Sections 3 (i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Considering the nature of allegation against the appellant to have entered into the house of the informant in wee hours of night and attempted to ravish the family inmate. In my view, this is not a fit case for grant of anticipatory bail. Hence,
Patna High Court CR. APP (SJ) No.1334 of 2018 dt.10-09-2018 2/2 there is no need to interfere with the impugned order, whereby prayer for anticipatory bail of the appellant has been rejected. However, Annexure 2 would reveal that parties have entered into compromise. If, that is the position, fate of the trial is known. Hence, in the event of surrender of the appellant, the court below shall dispose of the prayer for bail without being prejudiced by this order and considering the factum of compromise between the parties.
Accordingly, this appeal stands dismissed.
