Petitioner seeks bail in Mojahidpur P.S. Case No. 331/17 registered for the offence under Sections 394, 307/34 of the Indian Penal Code.

F.I.R. is against unknown. Informant has alleged in the F.I.R. that while on 01.11.2017 he was accompanying his villager Md. Guljar Mansury to his Domi Lodge Panshala Road Chowk and when he reached near Crisant School all of a sudden 3-4 miscreants encircled him and snatched the bag of Md.Guljar Mansury from the shoulder of the informant and they also snatched Rs.500/-from his pocket. When the informant called Kamruddin his co - villager going ahead of him one of the Miscreants fired upon the informant causing injury on his left Panjara and his little finger of his right hand as a

Submission on behalf of the petitioner is that he is not named in the F.I.R. No T.I.P. has been held in this case and he has been falsely implicated in this case only on the basis of confessional statement. Nothing has been recovered from his possession. Except confessional statement nothing has come against him. He is accused in one more case also in which he is on bail. He is in jail custody since 25.01.2018. Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur, in Mojahidpur P.S.Case No.331 of 2017.
