2. The petitioner seeks bail in connection with Ujiyarpur PS Case No. 348 of 2022 instituted for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

3. As per allegation in the FIR, the informant alleged that on the fateful day, eight persons entered into his jewellary shop and they have forcibly obtained the keys of his locker and taken away gold silver and cash.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to dirty village politics. Nothing has been recovered from the conscious possession of the petitioner. He further submits that petitioner is

Patna High Court CR. MISC. No.80309 of 2023(2) dt.20-12-2023 2/2 not named in the FIR and is in judicial custody since 20.01.2023. Petitioner has not put on Test Identification Parade. Learned counsel for the petitioner submits that similarly situated co-accused persons namely, Vikash Kumar @ Dhiru, Vishal Paswan @ Vishal Kumar Paswan, Amarjeet Kumar and Rajiv Ranjan Kumar @ Rajiv Yadav @ Neeraj have been granted bail by the Court below in BP Nos. 237 of 2023, 518 of 2023, 423 of 2023 and 561 of 2023 vide order dated 24.03.2023, 11.05.2023 and 09.05.2023 respectively.

5. Learned APP opposes the prayer for regular bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Dalsingsarai, Samastipur in connection with Ujiyarpur PS Case No. 348 of 2022.
