JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner, learned APP for the State, learned counsel for the informant. The petitioner seeks bail in Sahpur P. S. Case No. 208 of 2018 instituted for the offence under Section(s) 341, 323, 324, 326, 307, 302 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that this petitioner gave Bhala blow on the chest of the father of the informant on account of which he fell down and started tossing in pain. The father of informant was taken to the Shahpur referral hospital for treatment where he was declared dead.

Case diary has been received, wherein, the postmortem report of the deceased is available. The doctor has

In this manner, petitioner is the main assailant in this case. There is direct allegation against the petitioner of causing Bhala blow on chest of father of the informant . Learned counsel for the informant has appeared and opposed the prayer for bail. He has submitted that witnesses have also supported the case during investigation. Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
