JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Sathi P.S. Case No. 177 of 2017 dated 24.12.2017 instituted for the offences under Sections 448, 341, 323, 354(B), 308, 379, 504, 34 of the Indian Penal Code.
The petitioners are alleged to have entered into the house of the informant, assaulted the inmates and taken away valuables.
The learned counsel for the petitioners has
Patna High Court Cr.Misc. No.63320 of 2018(3) dt.11-12-2018 2/2 submitted that both the parties are neighbours and there is a counter version of the occurrence also vide Sathi P.S. Case No. 174 of 2017. The injured persons have received simple injuries and the petitioners' side also received injuries in the occurrence.
The petitioners do not have any criminal antecedents.
Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Sathi P.S. Case No. 177 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
