2. The petitioners have statutory remedy of appeal against the impugned order passed by the Circle Officer, Hilsa, Nalanda dated 10.10.2019 in Land Encroachment Case No. 13 of 2017-18 under the provisions of the Bihar Public Land Encroachment Act, 1956, which he has not availed.

3. Since the petitioners have not availed the alternative statutory remedy, I am not inclined to entertain this

4. This application is, accordingly, disposed of.

5. The petitioners shall, however, have the liberty to prefer appeal against the impugned order before appropriate forum, which shall be decided, in accordance with law.

6. If any appeal is filed within a fortnight from today before the appellate authority, the Court expects that the appellate authority shall condone the delay in filing the appeal.

7. It is further observed that if any prayer is made for interim order during the pendency of the appeal, the same should be considered, in accordance with law. (Chakradhari Sharan Singh, J) arun/- U
