2. The issue involved in the present writ application is similar to the case of Birendra Kumar vs The State of Bihar & Ors which has already been decided on 09.09.2025 in CWJC No. 8033 and 2025. Learned counsel for the petitioner,

Patna High Court CWJC No.18153 of 2025(2) dt.13-11-2025 2/3 therefore, prays that this case may be disposed of in light of the said decision of co-ordinate Bench of this Court passed in CWJC No. 8033 of 2025.

3. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel for the respondentState does not have any objection.

Considering the fact that the issued involved in the present writ application is similar to the case of Birendra Kumar vs The State of Bihar & Ors in CWJC No. 8033 and 2025, which has been decided on 09.09.2025, this case is disposed of in terms of the said order and liberty is granted to the petitioner to file an appeal before the District Teachers Appellate Authority, Gaya. In case, such appeal is filed within a period of four weeks from today along with a petition for condonation of delay, it is expected that the District Teachers Appellate Authority, Gaya shall consider the same on its own merit and decide the same expeditiously in terms of Bihar State School Teachers and Employees Disputes Redressal Rules, 2020 in accordance with law. It is expected that the District Teachers Appellate Authority, Gaya will pass final order on the appeal filed by the petitioner within six months from the date it represented.

5. With the aforesaid observation/direction, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
