JUSTICE SANJAY PRIYA ORAL ORDER 3/ 06-11-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in Bhawanipur P.S. Case No.129 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioners submits that petitioners have no criminal antecedents. It is also submitted that beside suspicion, there is no material against the petitioners either in the written report or in the case diary.

Learned APP has submitted that witnesses in para 52 and 53 of the case diary have raised suspicion against these petitioners that these petitioners were found going on motorcycle

Patna High Court Cr.Misc. No.64639 of 2018 (3) dt.06-11-2018 2/2 holding gun in their hands.

Petitioners are in custody since 12.06.2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Purnea, in connection with Bhawanipur P.S. Case No.129 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
