====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-01-2024 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Nawada (Kadirganj) P.S. Case No.685 of 2022, registered for the offences punishable under Sections 302/201 of the Indian Penal Code.
3. As per the prosecution case, unknown person has committed murder of the father of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the name of petitioner surfaced in this case during the investigation that he was lastly seen with the deceased. He also submits that there is no eye witness of the
Patna High Court CR. MISC. No.82702 of 2023(2) dt.15-01-2024 2/2 alleged occurrence and there is no cogent material against the petitioner except the fact that he was lastly seen with the deceased. Learned counsel submits that petitioner has no criminal antecedent and he has been falsely implicated in this case merely on the basis of suspicion. He further submits that petitioner is in custody since 26.08.2023.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Kadirganj) P.S.
