The petitioner seeks bail in a case registered for the offence punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that no country made wine was recovered from the conscious possession of the petitioner rather it was recovered from the motorcycle which did not belong to the petitioner. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent and is in custody since 04.08.2019.

No.70625 of 2019(2) dt.25-11-2019 2/2 In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani, in connection with Laukahi P.S.Case No.153 of 2019/G.R.No.1399 of 2019, subject to condition that the petitioner will deposit Rs.5,000/- (five thousand) in the Patna High Court Legal Services Committee.
