2. The petitioner seeks regular bail in connection with Musrigharari P.S. Case No. 127 of 2023 instituted for the offences punishable under Sections 380, 457, 411 / 34 of the Indian Penal Code.

3. It is a case of alleged theft of three mobile phones from the conscious possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case, there is general and omnibus allegation against the petitioner, he has got clean antecedent and petitioner is in custody since 24.08.2023.

5. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.81842 of 2023(2) dt.05-01-2024 2/2 bail of the petitioner.

6. Considering the facts and circumstances of the case and the period of detention of the petitioners, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Samastipur in connection with Musrigharari P.S. Case No. 127 of 2023.
