Mr. Smt. Gulnar Begam ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2018 The petitioner seeks bail in connection with Kamtaul P.S.Case No. 125 of 2018 registered under Sections 395 and 397 of the Indian penal Code.

Allegation as per the FIR is that while informant along with Kamlesh Kumar and Mintu Kumar were going by motorcycle, they were intercepted by the miscreants and upon alarm raised by the informant, one of the miscreants fled away from there but snatched Rs. 35,000/- from Mintu Kumar on the point of pistol and in the light of motorcycle, informant identified the miscreants as Ravi Kumar Rout, Bablu Rout, Kumar Samir, Maharshi Thakur, Sanjay Thakur, Bhanu Thakur, Narain Thakur and this petitioner and later on, villagers assembled there and one caught miscreant disclosed the name of this petitioner.

No.63084 of 2018(3) dt.13-12-2018 2/2 Submission of learned counsel for the petitioner is that petitioner is co-villager and he has falsely been implicated due to village rivalry and he is in custody since 26.08.2018. Heard learned APP also who has opposed the prayer of bail stating that apart from the informant, one tempo driver has also identified the petitioner from whom also Rs. 15,000/- was snatched.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. As such prayer of bail of the petitioner is rejected. (Vinod Kumar Sinha, J) sujit/- U T
