JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks regular bail in connection with Sohsarai P.S. Case No. 168 of 2018, registered for offences punishable under Sections 419, 420, 467 & 468 of the Indian Penal Code.

Allegation as per F.I.R. is that on suspicion police arrested the petitioner and some other accused persons succeeded in fleeing away and recovery of one ATM scanner and ATM card also from the possession of the petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no case under Section 420 of the I.P.C. is made out against the petitioner and he has having no criminal antecedents and he is in judicial custody since 23.08.2018.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court Cr.Misc. No.63866 of 2018(4) dt.04-12-2018 2/2 bail of the petitioner.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif, in connection with Sohsarai P.S. Case No. 168 of 2018, subject to the condition that one of the bailors must be of close relative of the petitioner and submit sufficient property within the jurisdiction of the court concerned.

However, it is made clear that if the petitioner again found in such type of case in future, the prosecution shall move for cancellation of his bail bonds.
