JUSTICE SANJAY PRIYA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Piro P. S. Case No. 19/18 instituted for the offence under Section(s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
In the written report, there is specific allegation against this petitioner of causing firearm injury on the head of the brother of informant on account of which he fell down on the ground and subsequently he died.
Case diary has been received.
Learned APP after looking into the case diary has submitted that in the postmortem report doctor has found head
Patna High Court Cr.Misc. No.64549 of 2018(3) dt.04-12-2018 2/2 injury due to firearm on the person of the deceased and cause of death has been said to be fire arm injury. Learned counsel for the informant has appeared and opposed the prayer for bail. He has submitted that this petitioner is the main assailant in the case.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order.
