The petitioners are apprehending arrest in connection with Bairiya P.S. Case No. 163 of 2019 for the offence under Section 489-A, 489-B, 489-C, 420, 414, 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners informed this Court that petitioner no. 2 has been arrested during the pendency of this case and as such his application for anticipatory bail has become infructuous.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and allegation against him

Patna High Court CR. MISC. No.70649 of 2019(3) dt.05-03-2020 2/2 is that he was involved in business of fake currency. Learned counsel, with reference to supplementary affidavit, would submit that the fake currency was seized from the house of Dinanath Chaudhary and he has been granted anticipatory bail by the Court below.

Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from his conscious possession, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bairiya P.S. Case No. 163 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
