Petitioner seeks bail in Buniyadganj P.S. Case No. 8/2015 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

The allegation against the co-accused including the petitioner is to have entered into the house of the informant, took her husband from her room and cut the neck of her husband, namely, Upendra Singh.

It appears that petitioner is named in the F.I.R. and there is specific allegation against him that he cut the neck of the husband of the informant with Fasuli.

Considering the facts and circumstances of the case and also in view of the fact that there is direct allegation against the petitioner, I am not inclined to enlarge the

Patna High Court Cr.Misc. No.63277 of 2018(3) dt.30-12-2018 2/2 petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the petitioner is granted liberty to renew his prayer for bail after completing one year of jail custody. (S. Kumar, J) Sanjay/- U T
