The petitioner and the informant are co-villager. Land dispute prevailing amongst them since before has been shown to be motive to commit offence regarding which narration goes as on the alleged date and time of occurrence, while the informant Dilip Verma alongwith his son Shashikant Verma was in a way to his house carrying a bag wherein ornaments were kept after closing the shop. The petitioner alongwith unknown intercepted him, brandished Chhura causing injury to Shashikant Verma and then, snatched away bag containing ornaments, cash. From the injury report, it is evident that Shashikant Verma has sustained simply injury caused by hard and blunt

Regard being had to the facts and circumstances of the case, let the petitioner Om Prakash Dixit, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. IX, Gopalganj in Uchakagaon P.S.Case No. 119/2018, subject to the conditions as laid down under section 438(2) Cr.P.C.
