Petitioner, who is in custody, seeks bail in connection with Dhamdaha P.S. Case No. 143 of 2018 registered for the offence punishable under Section 393 of the Indian Penal Code.
Allegation against petitioner and other co-accused is of snatching the money bag, mobile and his motorcycle key on the point of revolver and fleeing away. Looted mobile has been recovered from possession of petitioner. Police also recovered Rs. 15,000/- from possession of petitioner, however, petitioner claims money to be his money. Petitioner has criminal antecedent also.
Considering the nature of allegation against petitioner,
Patna High Court Cr.Misc. No.63369 of 2018(6) dt.27-11-2018 2/2 I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected. However, after one year of custody the petitioner would be at liberty to renew his prayer for bail.
