JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 9868 of 2018, arising out of Phulwari Sharif P.S. Case No. 854 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

There is recovery of 1.6 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that recovery is made from the house of petitioner.

In view of above facts and circumstances, this

No.73279 of 2019(2) dt.19-11-2019 2/2 application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on the basis of materials available on the record, without being prejudiced by this order and, if possible, to be disposed of on the same day.
