The petitioner is apprehending his arrest in connection with Gandhi Maidan P.S.Case No.317 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Excise and Prohibition Act.

As per FIR there is recovery of 16 ltrs. of liquor from the hut of the petitioner.

Submission of the learned counsel for the petitioner is that is that at the instance of his neighbour, she has been implicated in this case and she has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender and pray for

Patna High Court CR. MISC. No.73471 of 2019(2) dt.21-11-2019 2/2 regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid direction, this application is disposed of.
