This is an application for grant of anticipatory bail in connection with Nalanda P.S. Case No. 135 of 2018 registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code.

The allegation is regarding the petitioner having kidnapped the victim girl.

The learned counsel for the petitioner has submitted that though the victim girl, in her statement made under Section 164 of the Cr.P.C. before the learned Magistrate, has stated that the petitioner had taken her forcibly, however, later on, she had returned back, nonetheless, no allegation of any untoward incident having been committed by the petitioner has been

Patna High Court CR. MISC. No.73966 of 2019(2) dt.27-11-2019 2/2 levelled against the petitioner. It is further submitted that the petitioner has been falsely implicated in the present case and he is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 135 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
