JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2018 The petitioner is apprehending his arrest in connection with Ghoswari P.S. Case No. 28/2017, registered for offences punishable under Sections 341, 384, 386, 504/34 of the Indian Penal Code.
Allegation against the petitioner is of demand of Rangdari and also assaulting the informant and further it appears that the petitioner was accused in three other cases. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and there is general allegation of demand and as well as snatching of money and so far criminal antecedent is concerned, he is on bail in all those cases.
Heard learned A.P.P. also who opposed the prayer for
Patna High Court Cr.Misc. No.22004 of 2018 (3) dt.27-08-2018 2/2 anticipatory bail of the petitioner by stating that apart from the allegation, injury sustained by the informant was found to be grievous in nature.
Having heard both sides, considering the facts and circumstances of the case and nature of the injury, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and make prayer for regular bail, which would be considered on its own merit without being prejudiced by order of this Court. Accordingly, this application is dismissed.
