JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioners apprehend their arrest in connection with Pawana P.S.Case No. 54 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioners is that they have assaulted the wife of the informant, causing her death. Submission of learned counsel for the petitioners is that FIR itself shows that due to non-treatment the deceased died. Further submission is that Post Mortem does not show any injury on the person of deceased and there is case and counter case between the parties.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.21876 of 2018 (3) dt.25-06-2018 2/2 circumstances, let the petitioners, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara, in connection with Pawana P.S.Case No. 54 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
