The petitioner seeks bail in a case for the offence registered under Section 392 of the IPC.

The prosecution story, in brief, is that on 17.06.2019, on the point of pistol, two persons snatched Rs. 1,51,500/-, Driving License and Mobile Phone from the informant and fled away.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 19.08.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses

Patna High Court CR. MISC. No.76746 of 2019(2) dt.27-11-2019 2/2 alleged against the petitioner. The petitioner is not named in the F.I.R. There is no recovery from conscious possession of the petitioner. The name of the petitioner has come in the present case on the basis of confession made by the petitioner in connection with another case.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kishanganj, in connection with Bahadurganj P.S. Case No. 179 of 2019.
