2. The petitioner seeks bail in connection with Jamhore P.S. Case No. 25 of 2023 registered for the offence punishable under Sections 302 and 394 of the Indian Penal Code.

3. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 12.07.2023 in Cr. Misc. No. 34504 of 2023.

4. The petitioner is an accused of committing loot in a train and thereafter, the members of the gang killed one of the passengers.

5. Learned counsel for the petitioner has argued that the petitioner is a mere member of the gang who were involved

Patna High Court CR. MISC. No.81779 of 2023(2) dt.05-01-2024 2/2 in the loot in the train and he has not participated in the killing of the deceased. This fine argument can be tested only during trial and not at the stage of bail.

6. Accordingly, this application is dismissed.

7. The trial Court is again directed to expedite the trial.
