Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 303(2) and 3(5) of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that during marriage ceremony of his daughter, the accused persons including the petitioner came at 11 pm and on point of knife looted articles including ornaments and Suddu assaulted his maternal nephew by knife on head causing injury.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as

No.78766 of 2025(2) dt.04-12-2025 2/2 alleged in the FIR, it would manifest that no specific allegation is alleged against the petitioner rather specific allegation of stabbing the maternal nephew of the informant is against Suddu. It is also submitted that Suddu had approached this Court seeking anticipatory bail by filing Cr. Misc No. 65870 of 2025 and the same came to be allowed by an order dated 17-9-2025 passed by a learned co-ordinate bench, it is submitted that case of the petitioner is on better footing. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhagwanpur Hat P.S. Case No. 191 of 2025,subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
