JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Govindganj (Malahi) P.S. Case No. 07 of 2019 registered for the offences punishable under Sections 363, 366A, 468, 471, 385, 504, 506 and 34 of the Indian Penal Code. Petitioners are named in the FIR and allegation against them is of kidnapping.

Submission of learned counsel for the petitioners is that the statement of victim girl has been recorded under Section 164 Cr.P.C. in which she has stated that she fled away with petitioner No.1 and she married with him and also stated that he has not committed any other overt act with her and she has not named petitioner No.2.

Patna High Court CR. MISC. No.73474 of 2019(2) dt.21-11-2019 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioners.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Govindganj (Malahi) P.S. Case No. 07 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
