JUSTICE SANJAY PRIYA ORAL ORDER 5/ 25-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Begusarai Town P.S. Case No.510 of 2015 instituted for the offence under Section(s) 419, 420, 379 Indian Penal Code.

Counsel for the petitioner has submitted that total false and concocted allegation has been levelled against this petitioner. There is no involvement of the petitioner in the entire transaction and petitioner has been falsely named in the First Information Report.

In the written report, it is alleged that Smt. Rani Devi got facility of mobile banking in her account. She has

Patna High Court Cr.Misc. No.17929 of 2018 (5) dt.25-04-2018 2/3 transferred more amount in the account of Nawal Kishore Singh and this petitioner beyond the amount deposited in her account totaling Rs.25,25,000/-. Petitioner is said to be the son of Rani Devi.

It has been submitted that co-accused, Rani Devi, and Birendra Kumar have already been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 04.04.2018 passed in Cr. Misc. No.12214 of 2018 and order dated 19.01.2018 passed in Cr. Misc. No.57275 of 2017. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Begusarai Town P.S. Case No.510 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) Cr. P. C.
